The proposed Posting of Workers Enforcement Directive is being discussed by the European Council and the European parliament. We used feedback from the call for evidence to inform the UK’s negotiating priorities.

We received a total of 16 responses to the call for evidence, as follows:

  • 9 from business organisations
  • 5 from organisations representing workers
  • 2 representing legal groups

A summary of responses to 10 specific questions on the proposal is set out in the report. Overall, respondents agreed on the need to protect vulnerable workers and ensure unscrupulous businesses can’t evade their responsibilities. The proposed Posting of Workers Enforcement Directive is currently being discussed by the European Council and the European Parliament. Our negotiation priorities have reflected concerns raised by stakeholders.

This call for evidence seeks views from UK stakeholders on proposals from the European Commission for a Posting of Workers Enforcement Directive. The proposals are likely to have an impact on businesses who employ posted workers or post workers to other Member States and workers posted to or from the UK.

Those in the construction sector who post workers to other Member states or who make use of posted workers through sub-contracting work to EU contractors will be particularly affected.

Views and evidence are sought on the likely type and scale of these impacts, which will help inform the UK’s negotiating position.
