We have amended the impact assessment to take account of new assumptions received from consultation responses (and confirmation of the interpretation of Article 2.2 of the Directive from the European Commission’s consultants).

Some comments have been incorporated into the RoHS 2 guidance notes. However, many of the comments have been overtaken by the European Commission’s FAQ document published in December 2012.

The regulations have been adjusted, where appropriate, as a result of the feedback. The revised regulations came into force on 2 January 2013 (the transposition deadline for the Directive).

Consultation description

The Restriction of Hazardous Substances in Electrical and Electronic Equipment (RoHS) Directive aims to ensure EU Member States apply common restrictions on the levels of 6 hazardous substances that may be present in a wide range of electrical and electronic equipment. It also aims to minimise the end of life environmental impact of that equipment.

The new RoHS Directive has a different scope and obligations on those placing products on the market. This consultation will inform the process of transposing the directive into UK law. It seeks views on:

  • implementation policy
  • draft regulations
  • UK draft guidance notes
