The European Commission published its proposals to reform the existing EU insolvency Regulation in December 2012. Business Minister Jo Swinson has today announced that the UK Government has exercised its right under the EU Treaty to opt-in to the Regulation, and will participate fully in negotiations and implementation of the Regulation in its final form.

The Government has announced an independent review into pre-pack administration during a Parliamentary debate on pre-packs. A timescale will be announced at the time the review is launched in late spring.

Jo Swinson, consumer affairs Minister, today launched the debt management protocol under which consumers will not be charged any fees before signing a contract with a Protocol compliant debt management company. Providers have agreed to spread the recovery of their set up fees, over at least the first six months, making plans more affordable and sustainable.
