Energy Labelling of Household Tumble Driers
Commission Delegated Regulation (EU) No 392/2012 which supplements Directive 2010/30/EU with regard to energy labelling of household tumble driers has been published in the Official Journal of the European Union.
The Regulation, which repeals Directive 95/13/EC from 29 May 2012, places new responsibilities on suppliers and dealers, and brings household tumble driers into line with the new A+ labelling system.
However, it contains the wrong date for when the provisions will apply.
The current text of the Regulation states that the new the provisions will apply from 29 May 2012. However, the Commission has confirmed that this is wrong and that an addendum will be published, which will say that the provisions will apply from 29 May 2013.

Energy Labelling of Household Dishwashers and Washing Machines
Article 3(d) and (e) and Article 4(b), and (c) of Commission Delegated Regulations (EU) 1059/2010 and (EU) 1061/2010 with regard to energy labelling of household dishwashers and household washing machines now apply. The Articles affect printed advertisements and printed technical promotional materials published on or after 20 April 2012 placing new responsibilities on both suppliers and dealers.
Suppliers must now ensure that:
1. Any advertisement for a specific model of household dishwasher or household washing machine contains the energy efficiency class, if the advertisement discloses energy-related or price information.
2. Any technical promotional material concerning a specific model of household dishwasher or household washing machine which describes its specific technical parameters includes the energy efficiency class of that model.
Dealers must now ensure that:
1. Any household dishwasher or household washing machine offered for sale, hire or hire- purchase where the end-user cannot be expected to see the product displayed are marketed with the information to be provided by suppliers in accordance with Annex IV.
2. Any advertisement for a specific model of household dishwasher or household washing machine contains a reference to its energy efficiency class, if the advertisement discloses energy-related or price information.
3. Any technical promotional material concerning a specific model of household dishwasher or household washing machine, which describes its specific technical parameters, includes a reference to the energy efficiency class of that model.

Energy Labeling requirements for Household Refrigerating Appliances and Televisions
The second stage requirements for the energy labeling of Household Refrigerating Appliances and Televisions (Delegated Regulations EU 1060/2010 and EU 1062/2010 which supplement Directive 2010/30/EU) shall apply from 30 March 2012. The requirements place legal obligations on suppliers and dealers with regard to marketing, advertisements and technical promotional material.
With reference to suppliers, Article 3 of both Regulations states that any advertisement for a specific model contains the energy efficiency class, if the advertisement discloses energy-related or price information and that any technical promotional material concerning a specific model which describes its specific technical parameters includes the energy efficiency class of that model.
With reference to dealers, Article 4 of both Regulations states that models offered for sale, hire or hire purchase where the end-user cannot be expected to see the product displayed, are marketed with the information to be provided by the suppliers, that any advertisement for a specific model contains its energy efficiency class, if the advertisement discloses energy-related or price information and that any technical promotional material concerning a specific model which describes its specific technical parameters, includes the energy efficiency class of that model.

Energy labelling of dishwashers and washing machines has already been hugely successful since its introduction in 1992. Today 90% of appliances sold in the EU are in class "A" – the best existing class. However, new technologies would allow reducing by half the energy consumption of an A-class product. The EU has therefore decided to extend the scale upwards with three new classes: "A+", "A++", and "A+++" for products with a better than A-performance.
Although the Regulations apply from 20 December 2011, Article 3(d) and (e) and Article 4(b), and (c) of both Regulations, shall not apply to printed advertisement and printed technical promotional material published before 20 April 2012.

The Ecodesign for Energy Related Products (Amendment) Regulations 2011
The Ecodesign for Energy Related Products (Amendment) Regulations 2011 (SI 2011 No. 2677), (made 5 November 2011), was laid before Parliament on 9 November 2011 and has a coming into force date of 1 December 2011.
The amendment also amends regulation 7(3) (a) of the Energy Information Regulations 2011.

Energy Labelling of Household Refrigerating Appliances and Televisions
Commission Regulations 1060/2010 (household refrigerating appliances) and 1062/2010 (televisions) shall apply from 30 November 2011.
Commission Regulation 1060/2010 will repeal Directive 94/2/EC while Commission Regulation 1062/2010, for televisions (which represent almost 10% of the average household's electricity bill) will mark the first time that manufacturers will have to declare the energy efficiency of their products, using an A to G scale.

Consultation Complete
The recent consultation exercise on the practical implementation and the procedures associated with the use of civil sanctions and the recovery of testing costs as laid out in the Energy Information Regulations 2011 (SI 2011 No. 1524) is now closed. Of the stakeholders consulted none responded.
The guidance document will be published and will be available to download accordingly.

NMO have issued a report following a recent market surveillance project on the energy labelling of domestic refrigeration appliances (PDF, 1.2 Mb) . The Energy Labelling Regulations cover the accuracy of claims on the energy label including energy consumption, energy class and volume.

Consultation on NMO Recovery of Testing Costs and Civil Sanctions Guidance
In July 2011, the UK Energy Information Regulations came into force. These Regulations transpose the requirements of the EU Energy Labelling Framework Directive (2010/30/EC).
Under the Energy Information Regulations 2011, the NMO as the appointed UK market surveillance authority have a new power to recover testing costs and to impose civil sanctions. The NMO is required by the Regulations to publish guidance on the recovery of testing costs and use of civil sanctions.
The NMO have produced a draft guidance document (PDF, 498 Kb) and accompanying consultation document (PDF, 199 Kb) . This guidance will be joint with the earlier agreed guidance for Ecodesign of Energy-Related Products Regulations, which have a similar enforcement regime and for which NMO is also the Market Surveillance Authority.
Changes from this earlier guidance are highlighted in the attached proposal.

New Energy Labelling Regulations In Force
The Energy Labelling Framework Directive 2010/30/EU has been transposed into UK law under Statutory Instrument 2011 No. 1524 and comes into force on 20 July 2011. The Regulations are available to download from the legislation page.
The new energy label is also available for dealers to download and complete, as an interim measure, between suppliers providing new labels on request from dealers.

Energy Labelling of Household Washing Machines
NMO have issued a report following a recent market surveillance project on the energy labelling of household washing machines (PDF, 1.0 Mb) . The appliances were also assessed for conformity to the Energy Related Products Regulation for household washing machines.

The 'New' Label
On 20 December 2010, new Commission Regulations supplementing Directive 2010/30/EU were published in the Official Journal of the European Union, with regards to the energy labelling of:

Household Dishwashers (1059/2010)

Household Refrigerating Appliances (1060/2010)

Household Washing Machines (1061/2010)

Televisions (1062/2010)
For dishwashers, refrigerators, and washing machines the new system introduces three new classes (A+ to A+++) to be added to the existing A to G class system.
For televisions, the new labelling system will be the first time manufacturers will have to declare the energy efficiency of televisions, based on the A to G class system.
The first requirements of all four Regulations will apply later this year.
The new labels have also been designed to be language free and will be included in the packaging of each appliance. It will allow retailers to easily attach the label to the appliances at the point of sale in order to avoid potential mislabelling.
