If you have come to the conclusion your product is exempt or outside the scope of the RoHS Regulations, then we recommend that you document the justification for this view and keep it in case you need to explain your decision to an enforcement body under the RoHS Regulations. If you find you have difficulty clearly justifying your product's exemption then you may want to revisit the question of compliance.
It may be that part of the justification for the exemption of your product is its intended use. If the intended use changes, you need to assess whether the product is still outside the scope of the WEEE Regulations. It may be important to educate your sales staff to ensure that they understand the potential issues associated with the RoHS Regulations, markets, use and primary function.
