Rules, Regulations and Procedures


The European Commission monitors and controls State Aid in the EU by requiring Member States to notify the Commission in advance of proposed State Aid in order to ensure compliance.

There are a few exceptions to the notification requirement, namely:

  • If your measure falls within the De Minimis regulation i.e. you are giving less than 200,000 Euros over three fiscal years
  • Measures which are covered under a pre-existing and approved scheme
  • Measures falling within the General Block Exemption regulation

If none of the above conditions are satisfied, you will need to obtain approval, contacting the State Aid Unit in the first instance. The following sections cover the various regulations and procedures in more detail.

Do I need to notify my aid project?

Does the Project contain State Aid? If not, there is no need to use the formal notification procedure. If the project contains State Aid, could it be granted as De Minimis Aid? Yes, if so there is no need to use the formal notification procedure. If the project cannot be granted as De Minimis Aid, Does the project fit under an approved existing scheme? Yes, if so there is no need to use the formal notification procedure. If the project does not fit under an approved existing scheme, can it be covered under the general block exemption? If so, there is no need to use the formal notification procedure. If the project cannot be covered under the general block exemption regulation, you must prepare to formally notify the EU commission.
